PART Sw 401  NEW HAMPSHIRE LOTTERY RULES FOR DISTRIBUTION OF PURSE MONEY TO RACE TRACKS

          Sw 401.01  Definitions.  The following definitions are set out for the purposes of the New Hampshire lottery commission distributing purse money to race tracks:

          (a) "Commission" means the New Hampshire lottery commission.

          (b) "Director" means the executive director appointed by the commission under authority of RSA 284:21-i, I.

          (c) "Purse" means the amount of the disbursement as determined by the commission, made to a licensed track.

          (d) "Race tracks" means the licensed dog and/or horse race tracks in New Hampshire.

PART Sw 402  DISTRIBUTION

          Sw 402.01  Eligibility Determination and Purse Amounts.  Distribution of purses shall be made only to licensed dog and/or horse race tracks in New Hampshire.  Each race track shall request, in writing, to the director the amount of purse distribution, and the dates the requested amount shall be used as the purse for a given race, to be given by the race track to the holder in accordance with RSA 284:21-i, III.

          Sw 402.02  Dates.  The race tracks shall submit their request to the director no later than March 31 of each calendar year.

          Sw 402.03  Commission Action. The commission shall determine, at their April meeting each calendar year, the amounts to be distributed to the respective tracks, not to exceed an aggregate sum of $325,000 for a single calendar year, pursuant to RSA 284:21-i, II(b), based on the following:

          (a) Historical amounts that have been distributed;

          (b) Yearly lottery sales at each location; and

          (c) Marketing efforts proposed by each location.

          Sw 402.04  Award.  Award of the purse by the commission to the respective race tracks shall be contingent upon the running of the race.
